When you sign up for our services, you agree to use them respectfully and lawfully and to keep your sign in credentials secure. Our payment provider Stripe handles all payment processing and stores payment information, so you can rest assured that your financial data is safe.

Any content you upload to Designer Tools is yours to keep - we will never use it without your consent. And while we hope you'll share your creations with others, please ensure you have the necessary rights to any copyrighted, patented or trademarked materials you include.

I'm just one person here developing Designer Tools, but I'm committed to providing you with the best experience possible. We reserve the right to make changes to the platform and services.

Legal version

By installing or using the Designer Tools extension, you represent and warrant that you have read and understood these Terms of Use and agree to be bound by them. If you do not agree to these Terms of Use, you should not install or use the extension.

We reserve the right to modify these Terms of Use at any time, and your continued use of the extension after any such modification constitutes your acceptance of the modified Terms of Use.

Use of the Designer Tools Extension

The Designer Tools extension is provided to assist designers and developers with their work. It provides various tools that help with alignment, accessibility checking, and collaboration.

You may use the Designer Tools extension only for its intended purposes and in accordance with these Terms of Use. You may not use the extension for any illegal or unauthorized purpose, or in any way that violates these Terms of Use or any applicable laws or regulations.

Subscription Options

Designer Tools offers several different subscription options. These include a free, logged-out tier that does not store any user information or settings; a free, logged-in tier that allows users to store guidelines and sync them between different browsers where the user is logged in; Designer Tools PLUS, which adds features like design overlays and grids; Designer Tools PRO, which includes accessibility checking and viewport testing; and Designer Tools TEAMS, which allows teams to collaborate and communicate on a page.

All features (except the ones from the TEAMS tier) will be available to try for free up to 5 times. When the user uses up their free tries, these features will be locked until they subscribe to the necessary tier.

Payment and Billing

All subscription payments for Designer Tools are processed by Stripe, our third-party payment provider. By subscribing to Designer Tools, you agree to provide valid and current billing information and authorize us to charge your chosen payment method for the subscription fees and any other charges incurred. You also agree to pay the applicable fees for the selected subscription plan, including any taxes and other charges imposed by the government.

We do not store or have access to any of your payment information, which is stored securely by Stripe. Stripe's use of your information is governed by its own privacy policy, which you should read carefully. By using Designer Tools and providing your payment information, you agree to be bound by Stripe's terms and conditions.

Please note that subscription fees are non-refundable, except where required by law. If you choose to cancel your subscription, your cancellation will take effect at the end of the current subscription period, and you will not be charged again.

Restrictions on Use

You may not copy, modify, distribute, sell, or lease any part of the Designer Tools extension, nor may you reverse-engineer or attempt to extract the source code of the extension. You may not use the extension in any way that could harm the extension or impair anyone else's use of it.

You may not use the extension to send unsolicited messages or spam, or to collect information from other users without their consent. You may not use the extension to harass, abuse, or harm others, or to impersonate or misrepresent your affiliation with any person or entity.

We reserve the right to terminate or restrict your access to the Designer Tools extension if you violate any of these Terms of Use or if we believe that your use of the extension may harm us, other users, or third parties.

User Content

Users of the Designer Tools Extension may be able to upload content, such as designs or comments, through the extension. By uploading content, users grant us a non-exclusive, royalty-free, transferable, sublicensable, worldwide license to use, store, and display the content solely in connection with providing the Designer Tools Extension to the user.

We will never use any uploaded content to promote Designer Tools or for any other purpose except as necessary to provide the Designer Tools Extension to the user. User-uploaded content will remain with the user and will not be shared or used in any way other than as explicitly stated in this agreement. We reserve the right to remove any user-uploaded content at any time and for any reason without notice to the user.

Intellectual Property Rights

The Designer Tools Extension and its contents, including but not limited to text, graphics, images, logos, icons, audio clips, video clips, digital downloads, and software, are the property of Designer Tools or its licensors. You may not copy, reproduce, distribute, publish, transmit, display, perform, modify, create derivative works of, or exploit in any way the Designer Tools Extension or any of its contents except as expressly authorized in writing by Designer Tools.

Warranties and Disclaimers

Designer Tools is provided "as is" and "as available" without warranty of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance. We do not warrant that Designer Tools will be uninterrupted or error-free. We do not guarantee the accuracy, completeness, or usefulness of any information provided through Designer Tools.

You acknowledge and agree that your use of Designer Tools is at your own risk, and that we shall not be liable for any damages of any kind arising from or related to your use of Designer Tools or any third-party content, products, or services made available through Designer Tools.

Limitation of Liability

You acknowledge and agree that Designer Tools, including all features and content, is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including without limitation, implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

In no event shall Designer Tools, its affiliates, officers, employees, agents, partners, or licensors be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses arising out of or in connection with your use of the extension, whether based on contract, tort, strict liability, or otherwise, even if Designer Tools has been advised of the possibility of such damages.

You acknowledge and agree that you use Designer Tools at your own discretion and risk, and that you will be solely responsible for any damages to your computer system or loss of data that results from the use of Designer Tools.

If you are dissatisfied with any portion of Designer Tools or with these Terms of Use, your sole and exclusive remedy is to discontinue using the extension.

Indemnification

You agree to defend, indemnify and hold harmless Designer Tools and its affiliates, and their respective owner and licensors (collectively, the "Designer Tools Parties") from and against any and all claims, actions, suits or proceedings, as well as any and all losses, liabilities, damages, costs and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Designer Tools Extension, including but not limited to, any violation by you of these Terms of Use or any applicable laws, regulations or third-party rights.

Termination

Designer Tools reserves the right, in its sole discretion, to terminate your access to all or any part of the Designer Tools Extension at any time, with or without notice, effective immediately, including but not limited to your subscription to any paid tier of the Designer Tools Extension. Upon termination, you must immediately cease use of the Designer Tools Extension, including any of its features.

Changes to the Terms of Use

Designer Tools reserves the right to change, modify, add, or remove portions of these Terms of Use at any time and in its sole discretion. Any changes or modifications will be effective immediately upon posting the revisions to the Designer Tools website or within the Designer Tools Extension. Your continued use of the Designer Tools Extension after the posting of any changes or modifications constitutes your acceptance of such changes or modifications. If you do not agree to abide by these or any future Terms of Use, do not use or access (or continue to use or access) the Designer Tools Extension. It is your responsibility to review these Terms of Use periodically to ensure that you are familiar with the most recent version.

Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which the Designer Tools extension is made available. Any disputes arising out of or related to this Agreement shall be resolved exclusively in the competent courts of that jurisdiction.

Miscellaneous Provisions

This Agreement between you and Designer Tools pertains to the use of the Designer Tools extension and supersedes all prior or contemporaneous communications and proposals, whether oral, written, or electronic. In the event that any provision of this Agreement is deemed unenforceable or invalid, the provision will be limited or removed to the minimum extent necessary to ensure that the rest of the Agreement remains enforceable and in full force.

Designer Tools retains the right to assign or transfer this Agreement, either wholly or partially, without restriction. The failure of Designer Tools to enforce any right or provision in this Agreement does not constitute a waiver of said right or provision.

This Agreement is not transferable, sublicensable, or assignable by you, except with Designer Tools' prior written consent. Any headings, captions, or section titles included in this Agreement are inserted solely for convenience and do not define or explain any section or provision hereof.

Designer Tools will provide any notices or other communications to you under this Agreement, including modifications to this Agreement, either via email or by posting to the Designer Tools website. For notices sent by email, the date of receipt will be considered the date on which the notice was transmitted.
